MINUTES OF THE PUBLIC MEETING OF NOVEMBER 27, 2007

Called to Order at 7:30 PM under M.G.L. Chapter 131, s.40 and the Hanson By-Law Article 3-13, §.5. by Frank Schellenger,Vice Chairman, in Meeting Room A at the Town Hall.

Notice of Intent

Notice of Intent for the proposed construction of a single family dwelling with associated driveway, septic system, grading and landscaping within 100 feet of a Bordering Vegetated Wetland at Lot 2, Lakeside Road, Map 88, parts of Lots 7 & 8 for RHD Realty Trust, 708 White Pine Tree Road, Venice FL   (DEP #SE175-0526)    

Mr. Schellenger reiterated that the Commission voted to close the hearing at the meeting of 11/13/07.  Immediately prior to that, the Commission voted on a motion to approve the project.  The motion failed in a 2-2-1 vote.  Mr. Schellenger stipulated that the Commission could proceed with a denial of the Order of Conditions if the reasons for said denial are identified with respect to the Massachusetts Wetlands Protection Act and the Hanson Wetlands Protection By-Law.  Mr. Kemmett stated that his reason for denying the project was “lack of information” and he was dissatisfied with the non-responsiveness from the representative of the applicant for additional information.  Mr. Kemmett is of the opinion that the Commission has regulatory control over the 100-foot buffer zone and if a proposal is within that area, it is within the Commission’s right to ask for certain information outlined in the Wetlands Protection Act.  Furthermore, if that information is not provided, the project can be denied.  Mr. Schellenger asked Mr. Kemmett to cite the particular regulation.   Mr. Kemmett thought that the DEP’s Stormwater Management regulations should apply and specifically, he would like to see the stormwater calculations for roof runoff.



Mr. Schellenger read from the Hanson By-Law in the Rules and Regulations under Information to
be Submitted ( §.7.02) that allows for runoff calculations by a Registered Professional Engineer.  Mr. Kemmett summarized by saying that if an applicant proposes to do work in a regulated area that significantly affects the water quality in the Wetlands, one of the eight interests of the Act, that is reason enough for denial.

 As the matter was not resolved the Commission made a:
